Acceptance of Terms

By accessing or using Clear Pano, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms.

Description of Service

Clear Pano provides a platform for creating, editing, and publishing interactive 360° virtual tours. Our services include:

• 360° panorama viewing and editing
• Hotspot and navigation creation
• Text overlay and branding tools
• Object removal and image enhancement
• Cloud storage and synchronization
• Tour publishing and sharing
• Team collaboration features

Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Ensuring your account information is accurate and current
• Notifying us immediately of any unauthorized use

You must be at least 16 years old to use this service.

Acceptable Use

You agree not to use Clear Pano to:

• Upload illegal, harmful, or offensive content
• Infringe on intellectual property rights of others
• Distribute malware or harmful code
• Attempt to gain unauthorized access to our systems
• Use the service for spam or unauthorized advertising
• Violate any applicable laws or regulations
• Upload content that violates the privacy of others without consent

Content Ownership

You retain ownership of all content you create and upload to Clear Pano, including panoramic images, tours, and associated data.

By using our service, you grant us a limited license to store, process, and display your content as necessary to provide the service. This license terminates when you delete your content or account.

You are responsible for ensuring you have the right to use and publish all content in your tours, including images, logos, and branding materials.

Subscription and Payments

• Subscriptions are billed monthly through the Apple App Store
• Prices are displayed in your local currency and are subject to change with notice
• Refunds are handled according to Apple's refund policy
• You can cancel your subscription at any time through your Apple ID settings
• Downgrading your plan may result in loss of access to premium features
• If you exceed your plan's tour limit, excess tours may be automatically unpublished

Auto-Renewal Terms

• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the same price as your current subscription.
• You can manage and cancel your subscriptions at any time by going to your Account Settings in the App Store after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
• Cancellation takes effect at the end of the current billing period. You will retain access to the subscription features until the end of that period.

Team Accounts

If you purchase team seats:

• You are responsible for managing team member access
• Team members can access and edit tours you share with them
• You remain responsible for all content created by team members
• Removing a team member does not automatically delete their contributed content

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

• Perform scheduled or emergency maintenance
• Modify or discontinue features with reasonable notice
• Suspend accounts that violate these terms

We are not liable for any loss resulting from service interruptions beyond our reasonable control.

Intellectual Property

Clear Pano and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or reverse engineer any part of our service without our prior written permission.

Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Clear Pano and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service.

Our total liability for any claims arising from these terms or your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Clear Pano and its operators from any claims, damages, or expenses arising from your use of the service or violation of these terms.

Termination

You may terminate your account at any time by canceling your subscription and deleting your account through the app settings.

We may terminate or suspend your account immediately, without prior notice, for violations of these terms or for any other reason at our sole discretion.

Upon termination, your right to use the service ceases immediately, and we may delete your data in accordance with our Privacy Policy.

Governing Law

These terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes by posting the updated terms in the app and on our website. Your continued use of the service after such changes constitutes acceptance of the new terms.
